Common terms and conditions

These Terms and Conditions govern the relationship between Sellers and Customers (Customers) who use the bigearlbikes.com electronic shop for the purchase of goods. By clicking on an object, a picture, a link (other than the Terms of Use) or a button located on the bigearlbikes.com website, you believe that you accept or agree to the Terms and Conditions described below. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA) as well as with the other legal acts in force in the Republic of Bulgaria.

"SELLER" is the internet site www.bigearlbikes.com, which is owned by SkrobanSky Ltd. and serves as a virtual platform for the sale of goods. Seller is the person with whom the User signs a distance contract for a particular item (item) in the online store.

"USER" is an authorized person who has agreed to these Terms and Conditions in connection with ordering and purchasing the goods offered in the online store.

"ELECTRONIC SHOP" is the website www.bigearlbikes.com, which serves as a virtual platform for offering goods for sale and for reaching agreement between SELLER and USER for ordering and buying and selling of a specific good (item).

"SkrobanSky Ltd." is a trading company based in Sofia, Ul. Hemus 51, which creates and maintains the e-shop, offers and sells parts for wheels in the store and determines the current terms and conditions under which the goods are sold. "SkrobanSky Ltd." has the full rights to unilaterally change the content of the website as well as the ways of accessing it.

"ORDER" is the consumer's request to the online store to purchase one or more specific goods (items). The order is packed and sent by courier to a pre-specified address in the Order by the User after being approved by email or telephone. Approval by email is by sending an email (confirmation email). Approval by phone is made after a call by an employee of the online store for confirmation.

"CONTRACT FOR SALE" is the contract concluded by distance through this electronic shop for the purchase and sale of goods between Seller and User.

"COURIER" is a trader who physically delivers the purchased goods to an address specified by the User and works under the requirements of the Postal Services Act,

2.1. Examining the bigearlbikes.com e-shop is completely free and accessible from all over the world.

2.2. In order to shop from the e-shop www.bigearlbikes.com, you need a password and e-mail registration or recipient's name, email, telephone and shipping address. Registration is completely free and is done by filling in the registration form. The registered customer has the opportunity to enjoy all the services of the store.

2.3. The user must specify the email and password, personal details and delivery addresses.

2.4. In the e-shop www.bigearlbikes.com, each item lists the price, the main features of the item and additional information to help make an informed choice when purchasing the product.

2.5. All prices listed on the site are in BGN with VAT included.

3.1. To make an order to an online store, the user must indicate:

3.1.1. a valid e-mail address;

3.1.2. true address for delivery of the goods and invoicing;

3.1.3. true contact details - two names, phone.

3.2. The order is activated, ie. To the e-shop, click on the "Confirmation" button, which is below the order delivery data, which button appears after the first one has been added to the basket and the first button "Add" is pressed.

3.3. . When a successful order is made, the user receives an order confirmation by e-mail at the email address specified by the customer. The email confirmation indicates the order, the order number, the date and time of the order. Phone confirmation is only performed if additional information or order specification is required.

3.4. In case the ordered goods (specific model) is not available, the consultant informs the User. If the User does not agree that the order should be referred to another item (an analogue model), the order may be canceled.

3.5. Orders in the e-shop www.bigearlbikes.com are accepted 24 hours a day, 7 days a week.

3.6 The online shop consultants www.bigearlbikes.com is:

From Monday to Sunday from 10:00 to 20:00.

3.7. Orders received with or without correct Buyer (User) data are canceled if the Provider does not receive the correct data within 48 hours after the order arrives. Such orders receive status "REFUSED" due to impossibility to be executed.

3.8. The user can refuse an order without having to mention the reasons for refusal.

3.9. Order cancellation can be done by phone or by e-mail (e-mail) to the e-mail address specified on the site - e-mail: info@bigearlbikes.com. In order for the refusal to be valid, the User must provide: the number of the order, the telephone number left in the order, his two names with which he is registered on the site, the email address (e-mail) with which he is registered on the site.

4.1. After an order from a User is received at www.bigearlbikes.com, the automated system of the e-shop notifies the User by e-mail about the successfully accepted order.

4.2. Delivery of ordered goods is not carried out on Sundays and public holidays.

4.2.1. Ordinary delivery - within 2 working days from the moment of order confirmation.

4.3. The seller uses the courier company Econt AD for deliveries, as the usual delivery hours are from 9.00 to 17.30.

4.5. Delivery is made to the exact address specified by the User (whether residential or business) or to the office of "Econt" AD in the city.

4.6. Delivery prices are described on the page of each product in the column "Delivery and Payment"

4.7. If the User does not provide access and conditions for delivery of the goods to the specified address within the specified period or does not go to the specified office of Econt AD to receive the goods in time, if he has chosen this option, the Seller is released from the obligation to perform the requested delivery.

5.1. By "cash on delivery" - payment in cash to the courier upon delivery;

5.3. For each ordered product the consumer must pay the price that is announced in the e-shop at the time of the order. The price of each product can change dynamically.

6.1. The consumer has the right to claim or return a product purchased from the e-shop within 14 days of receiving the product.

6.2. Withdrawal from the contract may be made to the courier upon delivery of the goods, if the goods are delivered after the deadline for reasons beyond the User and not due to force majeure.

6.3. In case of withdrawal from the contract, the User is obliged to return the purchased goods in undamaged commercial form and with a preserved label.

6.4. Upon withdrawal from the contract, if the User has paid for the goods, he is refunded the amount paid for the returned goods to a bank account specified by him within 30 / thirty / days after the return of the goods. Amounts are not refunded until the User returns the goods. If the goods are not returned within the period under item 8.1, the withdrawal from the contract shall not take effect.

6.5. Complaints are made when the purchased goods do not comply with the agreement between the parties to the contract of sale. The discrepancy in the agreement between the parties may be expressed in:

production defects of the goods;

ascertained shortages of parts of the goods;

the wrong product other than the one ordered was sent;

non-compliance with the declared size and / or color - goods sent in different size and / or different color from the ordered;

damage to the goods during transportation.

6.6. The complaint can be submitted to www.bigearlbikes.com. to the specified email address info@bigearlbikes.com, and at the same time the User must return the goods within 14 days.

6.7. In case of a complaint, the User can choose to replace the specific item for the same without defects or in another size, or another color, or return the goods against a refund. An e-shop consultant may suggest that the item be replaced with a completely different item when the prices are equalized - either the User pays extra if the other item is more expensive, or two items are offered for the same price, or the User is reimbursed the difference between exchanges and the new item, if the price of the new item is lower than the price paid by the User.

6.8. The return of the goods in case of complaint, in cases outside the factory defect or damage during transport, is carried out under the following conditions:

Preserved good commercial appearance (the goods are not torn, scratched, used,).

There is no damage caused by improper use.

Preserved original packaging and label.

6.9. The return of goods, either in case of withdrawal from the contract or in case of a complaint, can be made in the manner and at the address indicated on the goods receipt with which the User received the order.

6.10. When exchanging goods, the transport costs are at the expense of the User in both directions, unless the replacement was necessary due to the fault of the e-shop. In case the customer wants to replace or return a product, this can be done with the courier company Econt AD.

In case there is no office of the courier company "Econt" AD in the settlement of the User, he must contact the Seller to clarify the details of returning the goods.

7.1. All information published on the website www. bigearlbikes.com, is owned by SkrobanSky Ltd., incl. photos and descriptions of items. The e-shop entitles owners of other sites and users to post links to the online store www.bigearlbikes.com.

7.2. It is forbidden to copy texts from www.bigearlbikes.com and place them on other websites and online stores without the written consent of SkrobanSky Ltd. or to cite the source by inserting the following text: "Source: online store for bicycle parts www.bigearlbikes.com ”should be a link to www.bigearlbikes.com

8.1. The Seller of the goods is responsible for defects in the goods, for the performance of the distance selling contract, as well as for the refund of amounts paid.

8.2. SkrobanSky Ltd. does not bear any responsibility to third parties if such person considers that information published on the e-shop infringes someone's copyright or other intellectual property rights.

These General Terms and Conditions have been accepted by the manager of SkrobanSky Ltd. and the last change in them is from 01.06.2015.
